Any Register of members of Multi State Cooperative Society or shares kept by any multi state cooperative society shall be prima facie evidence of any of the following particulars entered therein, namely:
(a) the date on which any person entered in such register or list became a member; and
(b) the date on which any such person ceased to be a member. An Act to consolidate and amend the law relating to co-operative societies, with objects not confined to one State and serving the interests of members in more than one State, to facilitate the voluntary formation and democratic cooperative societies functioning immediately before re-organization of states as people's institutions based on self-help and mutual aid and to enable them to promote their economic and social betterment and to provide functional autonomy and for matters connected therewith or incidental thereto. The Central Government may, by notification, direct that any power exercisable by the Central Registrar under this Act (other than the power of registration of a multi state cooperative society) shall, in relation to such society, and such matters a may be specified in the notification, be exercisable also by any other officer of the Central Government or of a State Government as may be authorized by the Central Government subject to such conditions as may be specified therein: Provided that no officer of a State Government shall be empowered to exercise such power in relation to a list of national cooperative societies. A multi state society registered under the Central Act cannot takeover a cooperative society registered under a State Act, held the Gujarat High court, early this week. The UCBL later in 2006 got merged with Cosmos Cooperative Bank Limited (CCBL), a multi schedule bank registered under the Multi-State Cooperative Societies Act, 2002. CCBL in September 2009 issued notice for auction of Rotan’s property as he had defaulted on monthly repayments. The multi state cooperative societies (Amendment) Bill, 2010 was introduced in the Lok Sabha on November 15, 2010 by the Minister of Agriculture, Consumer Affairs, Food and Public Distribution, Shri Shared Pawar. The Bill was referred to the Standing Committee on Agriculture (Chairperson: Sheri beside Achaia), which is scheduled to submit its report within three months.
