Nothing in clauses (b) and (c) of sub-section (1) of Section 17 of. Registration Act, 1908 (16 of 1908) shall apply to- (a) any instrument relating to shares in a multi state cooperative society notwithstanding that the assets of the society cons whole or in part of immovable property; or (b) any debenture issued by any such society and not create declaring, assigning, limiting or extinguishing any right interest to or in immovable property, except insofar as it enter the holder thereof to the security afforded by a request instrument whereby the society has mortgaged, conveys otherwise transferred the whole or part of its immovable or any interest therein to trustees upon trust for the benefit holders of such debentures; or (c) an endorsement upon transfer of any debenture issued by such society. provisions of the 2002 Act are word to word same identical to Section 57 of the 1984 Act. of the Registration Act, 1908 provides provision in rear documents of which registration is compulsory of the cooperative society Act provides that clauses (b) and (c) of sub-section of the Registration Act shall not apply to certain documents. peremptory provision, which exempts certain documents registration. The following documents shall be registered, if the property to they relate is situate in a district in which, and if they have been execute. after the date on which, Act No. XVI of 1864, or the Indian Registrar 1866, or the Indian Registration Act, 1871, or the Indian Registration Act, 1908 came or comes into force, namely (i) other non-testamentary instruments which purport or create, declare, assign, limit or extinguish, whether in preset future, any right, title or interest, whether vested or contain the value of one hundred rupees and upwards, to or in mire property and (ii) non-testamentary instruments which acknowledge the reek payment of any consideration on account of the creation, assignment, limitation or extinction of any such right . debenture issued by any such co-operative society and not creating, declaring, assigning, limiting or extinguishing any right, title or interest to or in immovable property, except in so far as it entitles the holder thereof to the security afforded by a registered instrument whereby the co-operative society has mortgaged, conveyed or otherwise transferred the whole or part of its immovable property or any interest therein to trustees upon trust for the benefit of the holders of such debentures.
