in a multi state cooperative society with unlimited assets and liabilities or division of multi state cooperative societies , the members are allowed to draw and resign from membership and obtain the refund of amount due as laid down. In case of cooperative society with limited liability, no member of society is ordinarily permitted to seek withdrawal or refund of his shares. only provision for this contingency has been made by a cooperative society by creating a transfer fund, this facility can be availed to a limited extent of 5% of the aggregate up share capital of the society (excluding Govt. contributions) as on 31st March preceding year. In a group housing society, interest shall be payable member who has resigned his membership or has been expelled, on the amount after deducting the administrative expenditure. The member has to submit his resignation, giving 3 months notice, which is accepted by the Society. There is no need to seek prior permission for accepting. However, the society has to submit information to Registrar, cooperative within 15 days of passing of Resolution accepting the resignation 7, along with: (i) a photocopy of Resignation letter of the Member. (ii) Agenda item and copy of Resolution of Managing Committee (iii) Letter of Intimation to Registrar cooperative Societies. If no communication is received from Registrar within 30 days, then it w presumed that resignation is final. Letter of Acceptance of Resignation by Ma Committee is sent to member. Society is free to admit new member in his place after expiry of 30 days. " intervening period the amount to be refunded to the resigned member shall not be the society. The said amount shall be paid only after the stipulated period of 30 over (or in case there is no objection from this office) through an account payee only the record of which shall be kept in safe custody by the society. Generally, membership in an association is voluntary. An individual is free to join or resign from an association. multi state society Membership in an association can be terminated by resignation or withdrawal by the member. However, an individual’s resignation from an association is subject to financial obligations due to the association. The bylaws and constitution of an association constitute a contract between organization and its members. A bylaw restricting voluntary admission and resignation is invalid. A withdrawal subject to approval of an organization is also invalid. Moreover, unreasonable and arbitrary limitations on membership and withdrawal are considered invalid. A member of a corporation may resign by simple announcement of his intention to do so and no acceptance of the resignation is required to give it effect in the statement of objects and reasons .
