An amendment of the bye-laws of a multi state society shall, unless it is expressed to come into operation on a particular day, come into force on the day on which it is registered. We deal in all types of multi state cooperative society registration whether it is credit cooperative society or housing cooperative society or dairy cooperative society or any other multi state cooperative society. Where it appears to the Registrar that refusal of Amendment of Bye-Laws in multi state cooperative society is necessary and desirable in the interest of the co-operative society or class of co-operative societies, the Registrar shall direct the multi state cooperative society or the class of co-operative societies, as the case may be, to make amendment in the bye-laws within a period of sixty days, by convening a general body meeting of the co-operative society. Many of us are concerned with the working of Co-operative Housing Societies either as members of Managing Committees or as members of Co-operative Housing Societies. It is therefore necessary for all to have some basic idea about recent amendments to the Bye Laws. With this in mind the recent amendment in the Bye-laws have been short listed with note. Some minor, clarificatory and corrective amendments are not included. The proposal of amendment of bye-laws of societies are required to be approved in General Body Meeting with 2/3rd majority of its members and the same is submitted to the department within two months of the General Body Meeting along with a copy of the minutes of the General Body Meeting, four copies of existing and proposed bye-laws with justification / reason and the certificate from the secretary, president of the cooperative society with regard to the compliance of the provision of Cooperative Societies Act and Rules. The proposal received is examined by the Zonal Assistance Registrars of various zones of RCS office and the same is either approved or rejected on merits. Specific reason are given for not approving the proposed amendment and application for registration of multi state cooperative society with the Delhi Cooperative Tribunal. This new Bye Laws is added to make it mandatory for the society to follow the guide lines issued by the Government in the matter of redevelopment of Cooperative Housing Society.
