Every decision or order made under cooperative society shall if not carried out (a) on a certificate signed by the Central Registrar or any person authorized by him in writing in this behalf, be deemed to be a decree of a civil court and shall be executed in the same manner as if it were a decree of such court; or (b) where the decision or order provides for the recovery of money, be executed according to the law for the time being in force for the recovery of arrears of land revenue Provided that any application for the recovery in such manner of any sum shall be made- (i) to the Collector and shall be accompanied by a certificate signed by the Central Registrar or by any person authorized by him in writing in this behalf (ii) within twelve years from the date fixed in the decision or order and if no such date is fixed, from the date of the decision or order, as the case may be for the investment of funds of a multi state cooperative society (c) be executed by the Central Registrar or any person authorized by him in writing in this behalf, by attachment and sale or sales without attachment of any property of the person or a multi state cooperative society against whom the decision or order has been made. On receipt of the file from the Section Head, the senior accounts officer/ Junior Accounts officer shall peruse the same and makes his decision, which can be decided at his level. For matters which requires the sanction of the registrar of cooperative societies in Delhi, it shall be submitted to the Registrar of cooperative societies, through the Joint Registrar of cooperative societies, for order or decision or approval or permission, as the case may be. The facts giving rise to the present petition are in a narrow compass and to the extent necessary, are set out hereafter. The New Sub hash cooperative Group Housing society, respondent no. 2 herein is a cooperative group housing society registered under the Delhi cooperatives societies Act, 1972. This society was allotted a plot of land by the Delhi Development Authority bearing plot no. A-2 Paschal Vihar New Delhi for the construction of 58 flats for allotment to its 58 members. In respect of which an order for the super session of the committee and the appointment of the administrator thereof has been made, no appeal, revision or review there against shall lie or be permissible, and the sanction or requisition of the Reserve Bank shall not be liable to be called in question of multi state society.
